Sony Sued over Firmware Update 3.0

Being a Major Corporation like Sony, you are often times hit with lawsuits, some frivolous and others that are, well, frivolous! Don't misunderstand, there are cases that are legit and deserve to be brought to the courts but most of them are just petty, childish, even suspicious. That's why as a big company your legal department must be up-to-step readying themselves for every and any battle, hence this new case.

A man from Florida filed a class action lawsuit on Friday claiming his PS3 which was purchased on Jan. 3rd, 2009, was killed by September's firmware update 3.0.

His name is John Kennedy and the complaint was filed on October 3rd in Federal Court for the Northern District of California.

In the suit, there are two complaints: The first "that as a general rule, Sony 'encourages' PS3 owners to install the latest version of system software, Sony required users to install the firmware 3.0 update. The second: A Sony forum featured enough complaints about the firmware causing console failures that Sony responded with a firmware FAQ.

Do you think Sony's vulnerable in this case? Or is this guy looking to cash in?
